Safe Space Counselling Services – Terms and Conditions (Updated)

By visiting www.safespacecounsellingservices.com.au (“Site”), you agree to these Terms and Conditions. “You” and “your” refer to the Site visitor or client; “we”, “us”, and “our” refer to Safe Space Counselling Services. Accessing this Site constitutes acceptance of these Terms.

1. Site Use

  • You must be 18 years or older to use the Site.

  • Information provided on this Site is for informational purposes only and is not legal or medical advice.

  • You agree not to use the Site for illegal or unauthorised purposes or to post content that violates the rights of others.

2. Intellectual Property

  • All content on the Site, including text, images, logos, and designs, is owned by Safe Space Counselling Services.

  • You may not copy, reproduce, distribute, or create derivative works without prior written permission.

3. Payment

  • Payment for counselling appointments must be made in advance at the time of booking.

  • Debt Collection Costs: Accounts not paid when due may be referred to a debt collection agency or legal process. You agree to cover reasonable costs associated with such collection, including collection agency fees, legal costs, and disbursements.

  • Late or overdue payments may incur additional administrative fees as outlined in your invoice.

4. Cancellations & Late Appointments

  • Client Cancellations:

    • Cancellations ≥48 hours before the appointment: no fee.

    • Cancellations <48 hours: no refund.

  • Late Arrivals: We wait 15 minutes for late arrivals; appointments are shortened by the time you are late. Exceptions may be made at our discretion.

  • Practice Cancellations: We may reschedule due to unforeseen circumstances; in such cases, no fees apply.

5. Limitation of Liability

  • We are not liable for indirect, incidental, or consequential damages arising from your use of the Site, services, or content.

  • Our total liability is limited to the amount paid for the service in question.

  • We do not guarantee outcomes of counselling, advice, or content provided on the Site.

6. Third-Party Links & Resources

  • Links to external websites do not imply endorsement. We are not responsible for the content, policies, or availability of third-party websites.

7. Indemnification

  • You agree to indemnify and hold Safe Space Counselling Services harmless from claims, losses, or damages arising from your breach of these Terms or use of our Site or services.

8. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of Victoria, Australia.

  • Disputes should first be resolved through good-faith negotiation. If unresolved, disputes may be submitted to the Australian Arbitration Association, conducted in Melbourne or via telephone. Arbitration decisions are binding.

9. Entire Agreement & Waiver

  • These Terms represent the entire agreement between you and Safe Space Counselling Services.

  • No waiver is valid unless in writing and signed by us.

10. Disclaimers

  • While we strive to provide accurate information, the Site and services are for educational purposes.

  • You are responsible for your use of information and services, and we accept no liability for personal actions or outcomes.
